Align Technology is a global medical device company with industry-leading innovative products such as Invisalign® clear aligners and iTero® Intraoral scanners.  It is one of the most exciting medical device companies in the market today.  The company is seeking to add an experienced Senior Patent Agent to its growing intellectual property team.

The ideal candidate will have at least five years of experience drafting and prosecuting patents.  He/she should have a BA or BS from an accredited college and be a member in good standing of the USPTO.  Experience with medical devices, mechanical and manufacturing technologies, and/or software technologies is preferred.

As a Senior Patent Agent at Align Technology, you will participate in and support patent and intellectual property related matters for Align Technology with an emphasis on its patent portfolio, including patent drafting and prosecution.  You will closely interact with the Legal and Engineering groups and will be responsible for holding and running ideation meetings, acquiring information from engineers to fill out invention disclosure forms and writing and drafting patent applications.  You may assist in patent review and opinion work related to validity and scope.  In addition, you may work with engineers and attorneys to perform Freedom To Operate work and inform product design strategy and direction.

Responsibilities:

  • Prepare, prosecute U.S. and International patent applications in-house and with outside counsel 
  • Review invention disclosures, work with inventors, perform portfolio analyses
  • Work with biomechanics, biomaterials and software engineering teams, facilitating proactive development of new inventions and provide client counseling 
  • Assess IP related legal issues and provide timely counsel to business partners
  • Conduct patent landscape and third-party patent portfolio analysis
  • Conduct freedom-to-operate analysis
  • Assist with competitive Intelligence gathering and analysis
  • Assist in post grant proceedings
  • Assist in implementing policies and procedures relating to IP 

Requirements

  • Admitted to practice before the USPTO 
  • 5 - 10 years of patent prosecution experience, with at least 4 years at a law firm: drafting, filing and prosecuting applications for patents
  • Over all minimum 6+ years’ of experience
  • Bachelor’s Degree in Biomedical Engineering, Computer Engineering, Computer Sciences, Electrical Engineering, Mechanical Engineering or other relevant technical degree with demonstrated ability to draft medical device and software related patent applications 
  • Possess an in-depth understanding of the rules, regulations and procedures of the U.S. Patent and Trademark Office
  • Possess knowledge of patent law and practice, including current judicial decisions and administrative rule changes and implementations 
  • Experience in litigation support and conducting infringement investigations a plus
  • This opening requires an individual with excellent analysis, evaluation, oral and written communications skills
