Reporting to Director, Asbestos Strategic Initiatives and Claims Counsel, this position helps execute and deliver on the established goals and objectives of the Company, the Claims Department, and the Asbestos Cross Functional Team (“ABCFT”), specifically in implementing the roadmap and vision for RiverStone’s asbestos defense litigation strategies and asbestos defense vendor management and spend, all in alignment with the Company’s strategic vision.

Litigation and Vendor Management:

  • Manage ABCFT processes related to selection and retention of defense counsel.
  • Accountable for rate approvals for asbestos defense counsel.
  • Assist in developing and managing panel of asbestos defense counsel and negotiating preferred vendor type arrangements and alternative fee arrangements.
  • Coordinates audits, quality reviews and ratings of asbestos defense counsel.
  • Develop measurements regarding asbestos ALAE; monitor and report on asbestos ALAE development and progress toward goals.
  • Support Claim Center and other system enhancements concerning vendor selection and work flow.
  • Act as departmental resource in the development of asbestos Claims Analysts’ litigation/vendor management skills and in resolving litigation management/vendor problems.
  • Define, train on and implement asbestos defense Litigation Management processes and protocols across Claims Department
  • Implement asbestos defense-related vendor selection and evaluation processes and protocols and ensure maximum value is received by RiverStone for every asbestos defense-related ALAE dollar spent. 
  • Drive efficiencies in and continuous improvement of departmental and company processes.
  • Identify, analyze and develop solutions for complex asbestos liability issues.
  • Develop and implement strategies to efficiently manage RiverStone’s affiliates’ total cost ofasbestos claim liabilities.

 Trial Management:

  • Assist ABCFT members in trial counsel strategy calls.
  • Develop effective processes to identify cases that may proceed to trial or are otherwise volatile and collaborate with ABCFT members to manage these cases appropriately through resolution.
  • Manage departmental trial calendar.
  • Monitor trial status and outcomes, and report to Claims Management on cases approaching trial and in trial.

 Defense Strategic Initiatives:

  • Assist in developing, deploying, and evaluating asbestos defense counsel selection, case development, trial and resolution strategies for strategic defense litigation initiatives.
  • Identify trends and provides training on solutions and approaches. 

 Compliance:

  • Advise and make recommendations to the ABCFT members of compliance issues including Medicare, DOI, and other inquiries.
  • Advise Team members on state-specific requirements affecting claim handling.
  • Evaluate legal developments in asbestos, latent claims, and insurance; assess impact on claims and communicate developments to the Team. Compile and maintain information in accessible format as a resource to the Team.

Requirements

  • Experience analyzing statistical reports and identifying claims trends.
  • Leadership skills including team development, goal setting, delegation and project management.
  • Must be able to prioritize and handle multiple assignments or projects simultaneously and meet established deadlines.
  • Strong computer skills and knowledge of database management software (i.e., Access and Notes) and application software (i.e., MS Word, Excel and PowerPoint) is required.
  • Strong written and oral communication, as well as presentation skills.
  • In-depth understanding of legal principles of tort and insurance law as applied in litigation. Must be able to evaluate and direct trial and resolution strategies.
  • Excellent interpersonal skills with an ability to interact with people at all levels of the organization, with affiliates, and with external parties as a representative of the company.
  • Ability to manage disagreements and conflict, and to maintain poise in contentious situations.
  • Customer service oriented with the ability for developing long lasting relationships with internal and external business partners.
  • Empowered to make decisions within job description and authority. Seeks guidance where appropriate.
  • Seeks continuous development by identifying areas for growth and improvement. Works with the continuous improvement team to implement process and technical improvements.
  • Understands Key Performance Indicators and manages towards those priorities
Experience:
  • At least 5 years of litigation and/or trial experience and 5 years of Claims Management or equivalent experience preferred
Education:
  • J.D. and bar admission in good standing required
Travel:
  • Many times per year
