Biotech Patent Attorney

We have an exciting new opportunity to join our global team in Bloomington, MN. KWS is seeking a Biotech Patent Attorney who will be responsible for Intellectual Property (IP) matters in the US focusing on invention management and freedom-to-operate (FTO). 

This role will also steer IP matters in South America and Canada through coordination of external counsel.  The Biotech Patent Attorney will work in close collaboration with the IP team based in Europe and provide IP advice to colleagues in R&D, Breeding and Business roles across KWS subsidiaries in the Americas.

Essential Job Functions:

  • Responsible for IP matters in US focusing on invention management (including some licensing)
  • Steers IP matters in South America & Canada through external counsel
  • Provides IP expertise and leadership to KWS subsidiaries in the Americas to expand and maintain robust IP portfolios in the areas of crop biotech, genome editing, digital farming, biologicals and other agricultural fields  
  • Accompanies research projects from ideation to product commercialization to identify IP generation opportunities and to steer patent prosecution and efficient maintenance in line with business needs
  • Directs Freedom to Operate (FTO) analyses for the Americas; devises mitigation strategies and workarounds to ensure FTO for business operations
  • Manages and strengthens effective and cost-efficient network of external IP service providers
  • Contributes to the global IP network of the KWS Group, headquartered in Einbeck, Germany
  • Develops and implements policies/practices to mitigate IP related risks and promote compliance with existing and developing law
  • Monitors legal developments and educates business units on relevant topics
  • Travels frequently on behalf of the business, both domestic and international, approx. 25-30%

Requirements

Required Qualifications:

  • Juris Doctor from an accredited law school
  • Admitted to practice law and is in good standing in at least one state and presently represents clients in patent matters before the USPTO
  • MSc or PhD in life sciences, biology, agronomy, plant breeding or related field
  • Minimum of 5+ years of IP or relevant direct industry experience as a “hands-on” patent attorney
  • Pro-active and goal-oriented entrepreneurial mindset with leadership capacities
  • Excellent analytical, presentation and communication skills
  • Strong intercultural skills with proficient English
  • Excellent interpersonal, facilitation and communication skills with the ability to translate legal information and directives back to colleagues, business units and international colleagues
  • Self-confident with the ability to work comfortably and effectively in a changing and fast-moving work environment
  • Proven track record of success and progressive advancement in previous “hands-on” legal roles

 Preferred Qualifications:

  • Background in South American or Canadian IP laws
  • Spanish, Portuguese or German language skills
  • 3+ years of international experience, working in a team environment
