This is a senior litigation attorney position in Intact’s U.S. Coverage Litigation Group.  Independently represents the company in complex coverage disputes before courts, arbitration panels, and mediators.  Advises claim professionals in their handling and resolution of litigated coverage disputes.  Responsible for completion of caseload of high complexity, whether by settlement, trial or appeal.  Manages assigned staff and coaches and mentors attorneys.

Responsibilities

  • Handles coverage litigation as lead counsel, representing the company in multiple federal and state jurisdictions through all phases of litigation.
  • Responsible for driving litigation to completion through motion practice and trial work of high complexity, whether by settlement, trial or appeal. 
  • Uses best practices to most efficiently and economically protect the interests of the company on all assigned cases. 
  • Manages staff, including development, goal setting, skill assessment, staff selection, role alignment, and performance appraisals.   Provides frequent communication and measurement of corporate and local goals.
  • Coaches and mentors junior members of the team through all phases of litigation to resolution.
  • Interfaces and provides counsel to claims professionals as litigated coverage disputes  develop through trial, dispositive motion practice or alternative dispute resolution.
  • Reviews and reports all large cases to managing attorney and prepares timely reports as required and schedules/attends conferences with other claim professionals to review pending litigation.
  • Actively provides strategic and tactical input to management on budgetary and office operations.  Provides consultation as to the proper resolution of defense files.
  • Maintains a strong professional knowledge of legal environments in multi-jurisdictional practice and applies this knowledge effectively.
  • Collaborates with the group’s paralegals, assistants, attorneys, management, and the company’s claim professionals in a team-oriented environment.

  • Significant federal practice experience and working knowledge of the Federal Rules of Civil Procedure and Federal Rules of Evidence.
  • Must have the ability to analyze and resolve complex third-party and first-party property commercial or specialty coverage issues.
  • Significant federal motion practice and a proven track-record as lead coverage counsel on complex coverage disputes through resolution.
  • Strong management skills, including informal training and formal development of staff.
  • Familiarity with the procedural and substantive law in all 50 states and a sense for judiciary objectives in resolving contractual responsibilities.
  • Must have proven critical thinking, decision making, problem-solving, communication, negotiation, and teamwork skills. 
  • Must be proficient with Microsoft Office suite.

Education and Experience

  • 10 plus years of experience litigating coverage disputes.
  • 3-5 years of supervisory experience, preferred.
  • Substantial experience with drafting and finalizing motions, discovery depositions, mediations and trial preparation required.
  • Trial experience in State and Federal Court preferred.
  • JD required.
  • Admitted to practice law in at least one state and eligible for pro hac vice admission in other jurisdictions

Applicants from the West Coast preferred but applicants from Nationwide will be considered.
